LIABILITY WAIVER,  ASSUMPTION OF RISK,  RELEASE,  AND MEDIA CONSENT

I hereby acknowledge that I have carefully read and understand the terms set forth in this Liability Waiver, Assumption of Risk, Release, and Media Consent Agreement. I voluntarily agree to be bound by the terms outlined below.

ASSUMPTION OF RISK

I understand and acknowledge that participation in dance classes, rehearsals, performances, auditions, seminars, workshops, events, and other physical or related activities involves inherent risks, including, but not limited to, physical injury, illness, accident, disability, property damage, and, in rare circumstances, death.

I voluntarily assume all risks and responsibility for any injury, illness, accident, loss, or damage that may occur to me or my child in connection with participation in any event, class, program, rehearsal, performance, or activity presented, hosted, or conducted by The Intensive Collective, owned and operated by The Sirota Movement, LLC.

I understand that I and/or my child are responsible for being aware of our own physical condition, health, and limitations and agree not to participate beyond those limitations. I understand that it is my responsibility to seek appropriate medical advice regarding my or my child’s ability to safely participate when necessary.

If I am completing this agreement on behalf of a minor, I certify that I am the minor’s parent or legal guardian and have the authority to provide the acknowledgements, permissions, and consents contained in this Agreement on the minor’s behalf.

RELEASE AND WAIVER OF LIABILITY

To the fullest extent permitted by applicable law, I hereby release, waive, discharge, and agree to hold harmless The Intensive Collective, The Sirota Movement, LLC, all host venues, and each of their respective owners, directors, officers, agents, employees, independent contractors, volunteers, assistants, faculty members, guest artists, photographers, videographers, representatives, and affiliates (collectively, the “Released Parties”) from any and all claims, demands, causes of action, damages, losses, liabilities, or expenses arising from or relating to my or my child’s participation in any event, class, program, rehearsal, performance, or activity.

This release includes claims arising from the inherent risks of dance and physical activity and, to the fullest extent permitted by applicable law, claims arising from the ordinary negligence, acts, or omissions of the Released Parties.

I understand that this Agreement is intended to be as broad and inclusive as permitted by applicable law. Nothing in this Agreement is intended to waive any right or claim that cannot legally be waived.

ILLNESS AND COVID-19 ACKNOWLEDGEMENT AND ASSUMPTION OF RISK

I understand that participation in in-person events and activities may involve exposure to communicable illnesses and respiratory viruses, including COVID-19.

I acknowledge that COVID-19 is a contagious illness and that individuals may transmit COVID-19 or other communicable illnesses without immediately knowing they are infected or experiencing symptoms.

The Intensive Collective, The Sirota Movement, LLC, and host venues cannot guarantee that I, my child, or others attending an event will not be exposed to or infected with COVID-19 or another communicable illness.

By participating in The Intensive Collective events, programs, or related activities, I voluntarily acknowledge and assume the risk of exposure to or infection with COVID-19 and other communicable illnesses. I understand that such illness may result in personal injury, illness, disability, complications, or death.

I understand that exposure or infection may result from the actions, omissions, or negligence of myself or others, including participants, guests, employees, faculty members, volunteers, representatives, or host venue personnel.

To the fullest extent permitted by applicable law, I voluntarily accept and assume these risks and accept responsibility for any injury, illness, loss, or expense that may arise in connection with such exposure or infection.

I agree to comply with all applicable federal, state, and local laws, public health requirements, host venue policies, and event-specific health and safety procedures in effect at the time of the event. I understand that health and safety policies may be updated or modified based on current circumstances or venue requirements.

I agree not to attend or participate if I or my child are experiencing symptoms of a contagious illness or if participation would violate applicable public health guidance or event policies.

Failure to comply with applicable event or venue health and safety policies may result in removal from the event.

PHOTOGRAPHY, VIDEO, AUDIO, AND MEDIA RELEASE

I hereby grant The Intensive Collective and The Sirota Movement, LLC the irrevocable right and permission to photograph, film, record, and otherwise capture my or my child’s image, likeness, voice, performance, and participation during classes, rehearsals, performances, programs, events, and related activities.

I authorize The Intensive Collective and The Sirota Movement, LLC to use, reproduce, edit, publish, display, distribute, and create derivative works from such photographs, video recordings, audio recordings, and other media for marketing, advertising, promotional, educational, editorial, archival, social media, website, digital, print, broadcast, and other lawful business purposes without compensation to me or my child.

I understand and agree that photographs, video recordings, audio recordings, or other media may be published on the Internet, websites, social media platforms, digital advertisements, promotional materials, and other public-facing media.

I understand that I or my child may be identified by first name, full name, program affiliation, title, or other relevant identifying information in connection with such media.

I waive the right to inspect or approve the final photographs, videos, recordings, edited materials, captions, advertisements, or other finished products in which my or my child’s image, likeness, voice, or performance may appear.

I understand and agree that all photographs, video recordings, audio recordings, digital files, and other media created by or on behalf of The Intensive Collective or The Sirota Movement, LLC shall remain the property of The Sirota Movement, LLC.

I hereby release and forever discharge The Intensive Collective, The Sirota Movement, LLC, host venues, and their respective owners, employees, contractors, faculty members, photographers, videographers, agents, and representatives from claims arising from the authorized use, publication, or distribution of such media, including claims relating to privacy, publicity rights, or use of likeness, to the fullest extent permitted by applicable law.

ACKNOWLEDGEMENT AND AGREEMENT

I understand that this Agreement affects legal rights and includes an assumption of risk, release of liability, and consent to the use of photography, video, audio, and other media.

If any provision of this Agreement is determined to be invalid or unenforceable, I understand that the remaining provisions shall continue in full force and effect to the fullest extent permitted by law.

I have had the opportunity to carefully review this Agreement before accepting its terms.

By checking the acceptance box below, I acknowledge that I have read and understand the statements above and voluntarily agree to the terms outlined in this Agreement. I understand and agree that my electronic acceptance serves as my electronic signature and evidence of my intent to be legally bound by this Agreement.
