I hereby acknowledge and agree to be bound by all the terms set forth herein in this Liability Waiver and Acknowledgement of Risk.

I voluntarily agree to assume all risks and responsibility for any injury or accident, which might occur to me or my child during any of the classes, rehearsals, performances, or activities.

I also exempt, release, and indemnify The Intensive (owned by The Sirota Movement, LLC) and host venues, its owners, agents, volunteers, assistants, employees, guest artists, faculty members, and/or students from any and all liability claims, demands, or causes of action whatsoever from any damage, loss, injury, or death to me, my children, or property which may arise out of or in connection with participation in any classes or activities conducted by The Intensive (owned by The Sirota Movement, LLC) and host venues.

I further voluntarily agree to waive my rights and that of my heirs and assigns to hold The Intensive (owned by The Sirota Movement, LLC) and host venues, its owners, agents, volunteers, assistants, employees, guest artists, faculty members, and/or students liable for such damage, loss, injury, or death.

I understand that I or my child should be aware of my or his/her physical limitations and agree not to exceed them. If I am signing this waiver for a child, I certify that I am the parent or legal guardian and have the right to waive these rights.

PLEASE READ CAREFULLY:

COVID-19: The novel coronavirus, COVID-19, has been declared a worldwide pandemic by the World Health Organization. COVID-19 is extremely contagious and is believed to spread mainly from person-to-person contact. It is believed that an individual can be in infected with COVID-19 without their knowledge and be asymptomatic. The Intensive (owned by The Sirota Movement, LLC) and host venues have put in place preventative measures to reduce the spread of COVID-19. However, The Intensive (owned by The Sirota Movement, LLC) and host venues cannot guarantee that I, my child, or anyone else will not become infected with COVID-19, including my spouse, guests, unborn child, or relatives. Participation in The Intensive events, related event, or activity, could increase the risk of contracting COVID-19.

By signing this agreement, I acknowledge the contagious nature of COVID-19 and VOLUNTARILY ASSUME THE RISK that I or my child may be exposed to or infected by COVID-19 by participating in The Intensive events, related events, or activities, and that such exposure or infection may result in personal injury, illness, permanent disability, and death to myself, my child, my spouse, guests, unborn child, or relatives. I understand that the risk of becoming exposed to or infected by COVID-19 at The Intensive events, related events, or activities may result from the actions, omissions, or negligence of myself or others, including, but not limited to, The Intensive (owned by The Sirota Movement LLC) and/or host venue employees, volunteers, and program participants.

I UNDERSTAND AND VOLUNTARILY ACCEPT AND ASSUME ALL the foregoing risks related to COVID-19 and accept sole responsibility for any injury or illness that may occur. Further, I UNDERSTAND AND AGREE that this release includes any Claims based on the actions, omissions, or negligence of The Intensive (owned by The Sirota Movement, LLC) and/or host venues, its employees, agents, and representatives, whether a COVID-19 infection occurs before, during, or after participation in any of The Intensive events, related events, or activities.

I further agree, for myself and other Releasors, to stickily comply with all applicable laws, rules, regulations and guidelines established by the Center for Disease Control and any federal, state or local public health official or governmental authority having jurisdiction over the Event, including without limitation any applicable requirements related to the use of face coverings, observation of social distancing guidelines, and cleanliness standards, policies and procedures. Failure to comply with such rules, standards, policies and procedures or such laws, rules, regulations and guidelines will result in automatic removal of non-compliant attendees from the Event.

I hereby grant The Intensive (owned by The Sirota Movement, LLC) and host venues the irrevocable right and permission to use photographs and/or video recordings of me (or my child) on websites and in publications, promotional flyers, educational materials, derivative works, or for any other similar purpose without compensation to me. I understand and agree that such photographs and/or video recordings of me may be placed on the Internet. I also understand and agree that I may be identified by name and/or title in printed, Internet or broadcast information that might accompany the photographs and/or video recordings of me. I waive the right to approve the final product. I agree that all such portraits, pictures, photographs, video and audio recordings, and any reproductions thereof, and all plates, negatives, recording tape and digital files are and shall remain the property of The Intensive (owned by The Sirota Movement, LLC) and host venue.

I hereby release, acquit and forever discharge The Intensive (owned by The Sirota Movement, LLC), host venue and employees of the above-named entities from any and all claims, demands, rights, promises, damages and liabilities arising out of or in connection with the use or distribution of said photographs and/or video recordings, including but not limited to any claims for invasion of privacy, appropriation of likeness or defamation. My signature is proof of my intention to execute a complete and unconditional waiver of all liability, either on behalf of my minor child or on my own behalf, to the fullest extent of the law.

I hereby covenant and agree that I will not file (or ask or allow anyone to file on my behalf or on the behalf of the Releasors), any charge, complaint, claim or lawsuits of any kind in connection with Claim released herein. This provision shall not apply to any claims that may not be waived as a matter of law or to any non-waivable charges or non-waivable claims brought before any regulatory agency or court of competent jurisdiction.
